These General Conditions of Sale (known as “CGV”) apply, without restriction or reservation, to all sales to non-professional buyers (“customers or the customer”), wishing to acquire the products offered for sale. (“the products”) by the “seller”, La Factorigami on the site www.lafactorigami.com . The products offered for sale on the site are the following: jewelry.
The choice and purchase of a product are the sole responsibility of the customer.
Product offers are within the limits of available stocks as specified when placing the order.
These T&Cs are accessible at any time on the site www.lafactorigami.com and will take precedence over any other document. The customer declares to have read these T&Cs and to have accepted them by checking the box provided for this purpose before the implementation of the T&Cs. online ordering procedure on the site www.lafactorigami.com . Unless proven otherwise, the data recorded in a computer system of the seller constitutes proof of all transactions concluded with the customer.

Article 2. Products
The products offered are those which appear on the La Factorigami website https://lafactorigami.com/, while stocks last. Factorigami reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description listing its main technical characteristics. The photographs are as faithful as possible but do not commit the seller in any way.
Each product offered on the site www.lafactorigami.com is the subject of a description carried out with the greatest care and detail possible. However, the photographs, texts, descriptions and graphics associated with the products presented on the site may not accurately reflect certain characteristics and these therefore do not constitute any contractual commitment to respect the reality of the product. The papers used are handcrafted and may therefore vary from one batch to another. Furthermore, the patterns of the papers used may vary depending on the location of the cut in the original paper (generally measuring 48cm x 64 cm). Thus, the pattern present on the jewel may vary depending on the photograph presented on the site www.lafactorigami.com . Finally, we cannot be held liable in the event of an error in one of these photographs or one of these texts or descriptions.
Article 3 - Price
The products are supplied at the current prices appearing on the site www.lafactorigami.com , when the order is registered by the seller.
Prices are expressed in Euros, “VAT not applicable, article 293 B of the CGI” due to the tax regime of La Factorigami (micro-enterprise).
Factorigami reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the customer.
Prices include shipping costs to most European countries but do not include any import and customs taxes specific to countries not belonging to the Schengen Area (Switzerland, Norway and the United Kingdom at the end of 2020)
The payment requested from the customer corresponds to the total amount of the purchase.
An invoice is established by the Seller and given to the customer upon delivery of the ordered products.
Customs, import and other taxes must be paid by the customer directly to the carrier depending on the country of destination.
Article 4 - Orders
It is up to the customer to select the products he wishes to order on the site www.lafactorigami.com , according to the following terms:
The customer chooses a product that he places in his basket, a product that he can delete or modify before validating his order and accepting these general conditions of sale. He will then enter his contact details and choose the delivery method. After validation of the information, the order will be considered final and will require payment from the customer according to the terms provided.
The sale will only be considered valid after full payment of the price. It is the customer's responsibility to verify the accuracy of the order and immediately report any errors.
Any order placed on the site www.lafactorigami.com constitutes the formation of a contract concluded remotely between the customer and the seller.

Factorigami reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons.
Factorigami will also be entitled to refuse any order placed by a Customer with whom there is a dispute relating to the payment of a previous order as well as any order that does not comply with these General Terms and Conditions.
In these cases, La Factorigami will inform the Customer by telephone or by email.
In the event that the products presented on the Site are no longer available or on sale at the time your order is sent, La Factorigami must promptly communicate to the customer, and in any case, before thirty working days from the following day the order, the possible unavailability of the products ordered. In the event of payment of the price, La Factorigami will reimburse the entire amount advanced for unavailable products.
Article 5 - Payment conditions
Before any order, the Customer has the possibility (optional) of creating an account on the La Factorigami website www.lafactorigami.co m . The account creation section is accessible directly from the horizontal menu bar. At each visit, the Customer, if he wishes to order or consult his account (order status, profile, etc.), will be able to identify himself using this information.
Factorigami allows the customer to order and pay for their products in several stages, with 2 payment options to choose from:
- Secure payment by Paypal or bank card (via the Stripe system): the customer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address (or provides news), the customer chooses the payment method of their choice: “Payment by Paypal or Credit Card”. The next step asks him to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the “Confirm my order” button. Finally, the customer is redirected to the secure Stripe or PAYPAL interface in order to securely enter their Paypal account or personal bank card details. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the customer may demand the cancellation of the card payment, the sums paid will then be recredited or returned. The liability of the bank card holder is not incurred if the disputed payment was made fraudulently and proven, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must contest, in writing, the debit with their bank, within 70 days following the transaction, or even 120 days. if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs for returning the sums may be charged to the holder.
Confirmation of an order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction.
Factorigami will send him confirmation of the registration of his order by email.

Article 6 - Deliveries
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by the local post office of the country concerned, delivery service with tracking, delivery without signature. Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the customer reimbursed. The seller La Factorigami will provide the customer with the tracking number of their package by e-mail. The customer is delivered to his home by his postman. If the customer is absent, he will receive a delivery notice from his postman, which allows him to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of La Factorigami. The customer is required to check, in the presence of the Post Office employee or the delivery person, the condition of the packaging of the goods and its contents upon delivery.
In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 7 - Transfer of ownership
The transfer of ownership of the products from the seller to the customer will only be made after full payment of the price by the latter, regardless of the delivery date of said products.
Article 8 - Right of withdrawal
According to the terms of article L221-18 of the Consumer Code “The customer returns or returns the goods to the professional or to a person designated by the latter, without undue delay and, at the latest, within fourteen days following receipt of the property by the customer in accordance with article L. 221-21 .
The customer will have to bear the direct costs of returning the goods concerned.
The right of withdrawal can be exercised online, using the contact page or at the email address lafactorogami@gmail.com and any other unambiguous declaration expressing the wish to withdraw.
Returns must be made in their original condition and complete (packaging) allowing marketing in new condition, accompanied by the purchase invoice.
Damaged, soiled or incomplete products will not be returned.
Return costs are the responsibility of the customer.
The exchange (subject to availability) or refund will be made within fourteen days from receipt by the seller of the products returned by the customer under the conditions provided for in this article.
Article 9 - Responsibilities of the seller
Factorigami, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.
Article 10 - Personal data
Generally speaking, you are not required to provide us with your personal data when you visit our website www.lafactorigami.com
However, the customer is informed that certain data must be collected by La Factorigami in order to be able to carry out its services. If the customer does not wish to communicate this data, La Factorigami will not be able to perform its services.
As detailed in the confidentiality tab, this data is as follows:
- Customer data: namely the data that the buyer must provide during the purchase: name, first name, full address, telephone number, email address, information relating to their means of payment
- Data relating to exchanges carried out with customer service

Data relating to means of payment (bank card number, expiration date, authorization number, security code) are collected directly by our service providers Stripe and Paypal.

No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.
Article 12 - Applicable law - language
These General Terms and Conditions and the operations resulting from them are governed and subject to French law.
These General Terms and Conditions are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.
Article 13 - Disputes
These conditions of the site www.lafactorigami.com are governed by French laws and any dispute or litigation which could arise from the interpretation or execution of these will be the exclusive jurisdiction of the courts on which the head office of the society. The reference language for settling any disputes is French.
